OBJECT
Hereinafter referred to as: “the seller” or PANISSEAU SA and “the buyer” or the customer.
The general conditions of sale below detail the rights and obligations of the seller and the buyer in the context of the sale of wines to Individuals, on French territory. They can be modified on the website without notice. The buyer is therefore invited to consult them during his visits to the site and to accept them when validating the order.
PRICE
Sales in bottles are carried out under caps representative of rights (CRD).
Prices include VAT ex our cellars, packaging included. VAT is 20%.
Shipping costs are free for purchases over €300 delivered to the same address. For any smaller order per delivery address, a flat rate contribution to shipping costs of €5 including tax is requested per address.
PAYMENT
Any order placed by the buyer is considered firm and final upon full payment thereof.
In the case of sales made remotely, payment is made when ordering by bank check or CCP payable to Château de Panisseau, by bank card or by bank transfer if the seller so wishes. For orders by mail, the buyer affixes his signature on the order form in the space provided for this purpose. For orders on the online store of the website, the debit of the credit card is immediately made after validation of the order by the buyer. No cash on delivery is accepted.
ORDERS
Only persons legally capable of entering into contracts relating to the goods and services offered by the seller may place an order.
When placing the order, the buyer agrees to provide the required information and attests to the veracity of the latter.
These General Conditions of Sale apply to the exclusion of all other conditions. The buyer is required to take cognizance of this when placing an order.
The choice and purchase of a wine is the sole responsibility of the buyer. He is invited to refer to the description of each product, available on the website, in order to know the properties and the essential particularities. Product offers are within the limits of available stocks. The special offers offered for sale cannot be modified by the buyer.
PRODUCT AVAILABILITY
The products are offered within the limits of available stocks.
In case of unavailability of one or more products after validation of the order, the seller undertakes to inform the buyer by e-mail or telephone of the partial or total cancellation of his order. In the event that the payment has already been debited from the buyer's bank account, the seller will refund the undeliverable product(s) as soon as possible by crediting the credit card used to pay for the order.
DELIVERY, DEADLINES, RECEPTION
The products ordered are delivered to the address indicated by the buyer.
Deliveries are made exclusively in Metropolitan France, including Corsica, by carrier.
The buyer undertakes to provide the seller with all the information necessary for the proper execution of the delivery of the products ordered, such as his exact address, his telephone number, the code of the front door or the useful indications for reaching at the place of delivery.
The carrier contacts the buyer to agree on a delivery date. The latter undertakes to be present during the delivery or to delegate the receipt of the goods to a third party who may receive the delivered products.
The carrier does not deliver upstairs or in the basement. The packaging commonly used for the 1 st Château de Panisseau wine are full cartons stamped "Château de Panisseau" of 6 or 12 bottles with a capacity of 75 cl, 24 half-bottles with a capacity of 37.5 cl or 6 magnums with a capacity of 150 cl. For products in stock, delivery takes place as an indication within 6 to 14 working days from receipt of payment and depending on the region concerned.
Exceeding delivery times cannot give rise to damages or deductions. In the event of delivery by a carrier, the seller cannot be held responsible for a delay in delivery due to the unavailability of the buyer after several appointment proposals.
The signature of the delivery receipt implying acceptance by the buyer, the latter must check the condition of the packaging as well as the contents of the package(s) on delivery, the quantity and the references delivered with regard to the order form.
The buyer has the right to refuse delivery if the product(s) are damaged. In case of damage or missing, the buyer is required to make specific reservations on the carrier's receipt. He will inform the seller by e-mail or telephone as soon as possible and at the latest within 24 hours of receipt of the order. If the buyer notices the damage after delivery, he must send the reservations directly to the carrier within 3 working days following delivery, by registered letter with acknowledgment of receipt. It will be up to him to send a copy of his complaint to the seller.
FORCE MAJOR
The seller will be relieved of its obligation to deliver in the event of the occurrence of an event of force majeure, such as fire, strike, accident and impossibility of supply. The buyer will be informed of the impossibility of making the delivery as soon as possible and at the latest within forty-eight hours following the occurrence of the event in question.
RIGHT TO RETRACT
In accordance with the provisions of Article L. 121-20 of the Consumer Code, the buyer has a period of 14 days from receipt of the goods without having to justify his decision, to assert his right to withdrawal by post or e-mail addressed to Château de Panisseau.
If the 14-day withdrawal period expires on a Saturday, Sunday or a public holiday or non-working day, it is extended until the next working day.
The buyer can return the products ordered to Château de Panisseau either by a service provider of his choice, or by the seller's service provider.
In all cases, the buyer will bear the cost of return.
Returned products, subject to the right of withdrawal, will only be taken back by the seller if they are returned in their original packaging and in perfect condition for resale. One or more damaged or partially consumed products cannot be reimbursed. In the event of exercise of the right of withdrawal, the seller reimburses the buyer as soon as possible and at the latest within 14 days following the date of receipt by the seller of the products returned by the buyer under the conditions provided for in this article.
The reimbursement of the buyer will be made, at the choice of the seller, either by bank transfer or by bank check addressed to the buyer.
TRANSFER OF OWNERSHIP AND INTELLECTUAL PROPERTY
The transfer of ownership of the products to the benefit of the buyer only takes place after full payment of the price, regardless of the date of delivery of the said products.
In the event of non-payment in full of the price, the seller shall have the option of pursuing the execution of the sale and requesting full payment of the price unless an action to claim the goods is undertaken, in which case, the deposits paid or any partial payments would remain acquired as damages to the seller.
All elements of the Château de Panisseau website are and remain its exclusive intellectual property. No one is authorized to reproduce, exploit, redistribute or use for any reason whatsoever, even partially, elements whether software, visual or sound. Any simple or hypertext link is strictly prohibited without the written consent of PANISSEAU SAS.
SALE OF ALCOHOLIC BEVERAGES
In accordance with article L. 3342-1 of the Public Health Code, the sale of alcoholic beverages to minors is prohibited. The buyer declares and undertakes to be 18 years old on the date of the order. Alcohol abuse is dangerous for health. It should be consumed in moderation. The consumption of alcoholic beverages during pregnancy, even in small quantities, can have serious consequences on the health of the child.
COMPUTER AND FREEDOM
In accordance with the “Information and Freedoms” law of January 6, 1978, the seller has the right to access, rectify, modify and delete data concerning him. The personal data collected may be transferred to third parties.

SKILL
The parties submit this contract to French law. Any disputes pursuant to these general conditions of sale could give rise, concerning their validity, their interpretation, their execution, their termination, their consequences and their consequences and which could not have been resolved between the seller and the buyer will be submitted to the competent courts under the conditions of common law.
Furthermore, the seller cannot be held liable for damage resulting from improper use of the purchased product. Its guarantee is, in any event, limited to the replacement or reimbursement of non-compliant products or affected by a defect.
Finally, the seller cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, an external intrusion or the presence of a computer virus.
